Terms of Service

These Terms of Service ("Terms") govern your use of HybroTechnology's website and services. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully.
1. Services
HybroTechnology provides offshore software development, AI-powered solutions, and technology consulting services. The scope, timeline, and deliverables of any engagement are defined in a separate Statement of Work (SOW) or Service Agreement signed by both parties.
2. Intellectual Property
Upon full payment, all custom-developed software, code, and deliverables produced specifically for the client become the sole property of the client. HybroTechnology retains ownership of its pre-existing tools, frameworks, libraries, and methodologies used in delivery.
3. Confidentiality
Both parties agree to keep confidential all proprietary information exchanged during the engagement. This obligation survives the termination of the service agreement. HybroTechnology adheres to strict NDA practices and ISO-aligned security standards.
4. Payment Terms
Payment schedules are defined in the applicable SOW. Invoices are due within 30 days of issuance unless otherwise agreed. Late payments may incur interest at 1.5% per month. HybroTechnology reserves the right to pause services for accounts overdue by more than 30 days.
5. Warranties & Liability
HybroTechnology warrants that services will be performed in a professional manner consistent with industry standards. Our total liability for any claim arising under these Terms shall not exceed the fees paid by the client in the three months preceding the claim.
6. Termination
Either party may terminate the engagement with 30 days written notice. The client is responsible for payment of all work completed up to the termination date. Provisions relating to IP ownership, confidentiality, and payment survive termination.
7. Governing Law
These Terms are governed by the laws of Vietnam. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 60 days, disputes shall be submitted to binding arbitration in Hanoi, Vietnam.
8. Changes to Terms
HybroTechnology may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website. Continued use of our services after the effective date constitutes acceptance of the updated Terms.
